Photo and video1. Scope
These General Terms and Conditions (AGB) apply to all contracts concluded between BusinessContentLab (hereinafter referred to as the “Service Provider”) and the customer (hereinafter referred to as the “Client”) regarding the provision of photo and video recordings, including drone recordings.
2. Conclusion of Contract
The contract is concluded when the Client accepts the offer and the Service Provider confirms it in writing. The Client agrees to these terms as soon as they sign the contract or place an order.
3. Scope of Services
The Service Provider provides photo and video recordings, including drone recordings, according to the agreed service description. The exact scope of services is specified in the contract or an offer. Additional services must be agreed upon separately and are subject to an additional fee.
4. Prices and Payment Terms
The prices for the provided services are specified in the contract or offer. All prices are exclusive of the statutory VAT. Payments are due without deductions within 10 days of invoicing. In case of late payment, interest on arrears of 5% above the current base interest rate of the European Central Bank will be charged.
5. Rights to Images and Videos
The Service Provider retains the copyright to all created images and videos unless otherwise agreed in writing. The Client receives the right to use the recordings for the contractually agreed purposes. Further use, especially editing or reproduction, requires the express written consent of the Service Provider.
The Service Provider has the right to use the created material in their portfolio, including publication on their website and social networks such as Instagram, with credit to the creator unless otherwise agreed in the contract.
6. Termination of Contract
In the event of contract termination, the Client bears the portion of the agreed payment and costs corresponding to the services provided up to the termination date. This portion is calculated based on the total gross amount of the order as follows:
Up to 30 days before the start of photo or video recording: 50% of the gross amount
Up to 14 days before the start of photo or video recording: 80% of the gross amount
Up to 7 days before the start of photo or video recording: 100% of the gross amount
For agreed installment payments, the corresponding partial amounts will be retained by BusinessContentLab.
7. Liability of the Service Provider
The Service Provider is only liable for damages caused intentionally or by gross negligence. For damages occurring during photo or video recordings with drones, the Service Provider is only liable within the framework of statutory liability and only if the damage was caused by their own fault. The Client indemnifies the Service Provider against all third-party claims resulting from the use of the recordings.
8. Liability of the Client
The Client is responsible for ensuring that all necessary rights, permissions, and releases for the planned recordings have been obtained. The Client indemnifies the Service Provider from any claims arising from violations of third-party rights.
9. Drone Operations
For drone recordings, the Service Provider will comply with all necessary permits and regulations. The Client is obliged to inform the Service Provider of any restrictions or special conditions for drone use at the recording location. The Service Provider is not liable for weather-related failures or legal restrictions affecting drone operations.
10. Data Protection
The Service Provider undertakes to treat all personal data of the Client confidentially in accordance with the General Data Protection Regulation (GDPR). The collected data will be used exclusively for contract fulfillment and will not be passed on to third parties.
11. Final Provisions
The law of the Federal Republic of Germany applies. The place of jurisdiction is the registered office of the Service Provider. Should any provision of these General Terms and Conditions be invalid or unenforceable, the remaining provisions shall remain unaffected.
